Montana Sodomy Ruling Appealed

On February 16, 1996, Judge Jeffrey Sherlock of the Montana First
Judicial District Court declared Montana's Deviate Sexual Conduct Statute unconstitutional
as a violation of privacy and issued a permanent injunction forbidding the State of
Montana from enforcing the statute against any adult engaging in consensual, private
intimate activity. Montana state Attorney General Mazurek today (3/14/96) filed an appeal
with the Montana Supreme Court in an attempt to nullify Judge Sherlock's injunction. The
court will have until the end of this year to make its decision whether to rule for or
against the injunction. Montana is by no means free as previously announced.
